Terms and conditions for all yoga retreats

Please read the terms and conditions of this contract before submitting your yoga retreat registration and payment.

In completing and submitting your registration for our retreat, you agree to be bound by these conditions, which constitute the following:

1. Reservation

To reserve your place on one of our retreats please complete the registration form and submit together with the non-refundable deposit specific to your retreat, provided you understand and agree to the services, excursions, meals and beverages which are included or excluded in the retreat.

2.  Payment

Final balances are due on the final payment deadline specified on the website and specific retreat page. If payment of the balance of the retreat price is not received by Indaba Group by the final balance due date we will assume that you will not be participating in the trip and cancellation charges in accordance with condition 3 will apply. 

3.  Cancellations

If you wish to cancel your retreat you must notify Indaba Group in writing, by email to om@yogaressa.com. Once we have received your notice, the cancellation will take effect subject to the following: if we are able to fill your spot by thirty days prior to the first day of the retreat, you will be issued a refund less $108 (one hundred and eight US dollars) administration fee. There will be no other refunds made at any time. In the event that you would like to transfer your fully-paid reservation to someone you know, we will accommodate this, at no charge, without refund to you.

If the retreat center location (the retreat venue) cancels the retreat, for example due to COVID regulations, your payment will be applied to a rescheduled retreat within 12 (twelve) months.

Indaba Group and its representatives Julie Murphy and Karen Pagano reserve the right in their absolute discretion to refuse a participant the right to participate in a retreat for any reason.

4.  Health and Fitness Requirements

You must be in good physical and mental health to participate in our retreats which sometimes take place in remote areas with little access to medical services or hospital facilities for serious problems. Medical and evacuation expenses will be your responsibility, which is why we strongly encourage you to purchase comprehensive travel insurance. Indaba Group and its representatives Julie Murphy and Karen Pagano reserve the right in their absolute discretion to refuse a participant the right to participate in a retreat on medical or fitness grounds. 

5.  Changes, Postponement, Cancellation or Delay

Indaba Group and its representatives reserve the right to make changes to any aspect of the retreat if, in the absolute discretion of Indaba Group, it is necessary to do so due to conditions that are likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political or military or terrorist or otherwise or if an act or omission of a third party prevents the retreat or the aspect of the retreat being undertaken in accordance with your booking or for any other reason considered necessary by Indaba Group.

If a designated teacher is unable to lead the trip for any reason, Indaba Group, in its discretion will enlist another teacher to lead the retreat. In the event of any change, modification, cancellation postponement or delay under this condition, you acknowledge that you will have no right of refund of the retreat price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation postponement or delay. 

If an activity or excursion is canceled by the provider of that activity or excursion, Indaba Group and its representatives Julie Murphy and Karen Pagano will use their discretion to substitute such activity or excursion with an alternative option where possible.

Indaba Group and its representatives Julie Murphy and Karen Pagano also reserve, in their absolute discretion, the right to cancel any retreat due to any government travel warning or advice, or any change in such warning or advice. In this event, we will do all we can to transfer any payments made to a future retreat with Indaba Group. If this is not possible, travel insurance may compensate you depending on the circumstances. 

6.  Insurance

We strongly recommend the purchase of comprehensive travel insurance and it is your responsibility to ensure that you are adequately insured for the full duration of the retreat in respect of illness, injury, death, COVID-19 regulations, loss of baggage and personal items and cancellation and curtailment.

7.  Force Majeure

If Indaba Group and its representatives Julie Murphy and Karen Pagano are prevented (directly or indirectly) from performing any of their obligations under this agreement by reason of act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside Indaba Group’s reasonable control, Indaba Group will be under no liability whatsoever to you and may, at its option, by written notice to you either cancel the retreat or take any other action as specified in condition 5.

8.  Assumption of Risk

You acknowledge that: the very nature of travel involves potential exposure to injury and in the countries and regions in which travel is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision may not be as high as those standards in your country of residence and may require flexibility and patience on your part; and operational control of the retreat may be in the hands of a third party and that your right of action in regard to any shortcomings of that third party’s performance is against the third party and not against Indaba Group nor its representatives Julie Murphy and Karen Pagano.

9. Permission to use Photo & Video

I hereby grant permission to Indaba Group and its representatives Julie Murphy and Karen Pagano the rights of my image, in video or still, and of the sound of my voice as recorded on audio or videotape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and I waive the right to inspect or approve the finished product wherein my likeness appears. By signing this release, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting. I will be consulted about the use of the photos or video recording for any purpose other than those listed above.

10. Email Communication 

You acknowledge that by registering for a retreat with Indaba Group that all trip-related materials and correspondences will be delivered by email. It is your responsibility to provide a valid email address and it is your responsibility to check your ‘Junk or Spam’ folder, should any correspondence be delivered there, and to mark them as a ‘safe sender’. Indaba Group holds no responsibility if you provide an invalid or outdated address or fail to receive our trip-related correspondence.

11. Shared Rooms and Roommate Assignments 

A registration for a shared-room option can only be confirmed when you have provided us with the name of your roommate and your roommate has completed their registration and payment. All shared-room requests will be accommodated on a first-come first-served basis.

12. Indaba Group Release and Hold Harmless

You acknowledge that you have chosen to attend this retreat and understand that all activities are voluntary. You acknowledge that despite precautions, accidents and/or physical injury may occur. If you experience any pain or discomfort, you agree that you will discontinue the activity, and ask for support from the instructor. You assume full responsibility for any and all damages which may be incurred as a result of your participation in the activities.

You understand that yoga and meditation are not substitutes for medical attention, examination, diagnosis or treatment, nor are yoga and meditation recommended or safe under certain medical conditions. You affirm that the status of your physical and mental health is sufficient to allow you to participate in the activities offered on this retreat. You agree that you will make the instructor aware of any medical conditions or physical limitations before class. If you are pregnant, become pregnant or you are post-natal or post-surgical, you verify that you have your physician’s approval to participate. You also affirm that you alone are responsible to decide whether to practice yoga and meditation, and your participation is at your risk. Furthermore you agree to take full responsibility for your behavior in addition to any damage you may cause to the facilities at the retreat location. 

In consideration of Indaba Group’s accepting your reservation, to the maximum extent permitted by law, you hereby release, waive, discharge, hold harmless and agree to indemnify Indaba Group and its officers, employees, agents, licensees, guides, other representatives, Julie Murphy, and Karen Pagano (called “Indemnified Parties”) from any and all claims,  damages, actions or losses for bodily injury, communicable disease including COVID-19, property damage, wrongful death, loss of services, lost profits, lost earnings, consequential, exemplary, direct, indirect or punitive damages or otherwise which may arise out of or occur during your travel and/or retreat stay, in connection with the trip, the retreat, or any activities conducted in conjunction therewith, unless caused by the gross negligence or willful misconduct of the Indemnified Parties; and regardless of the situation or circumstances giving rise to the claim you do hereby permanently waive any claims you have, or may at any time have, against the Indemnified Parties and you agree, by accepting the additional inherent dangers and risks associated with travel and with the retreat, not to make any claim against or seek any compensation from the Indemnified Parties in respect of any personal injury, illness, or death suffered by you or damage to or loss of property sustained by you as a result of your participation in the trip or the retreat.

You have been advised and urged to obtain comprehensive travel insurance to cover against loss resulting from trip cancellation or interruption, weather, natural disaster, strike, illness, job reasons, accident, sickness, evacuation, pre-existing medical conditions, baggage delay, loss, theft, COVID-19 regulations, and other losses associated with travel. You acknowledge that whether or not you elect to purchase or not purchase travel insurance, you will not look to any of the Indemnified Parties for reimbursement for any loss suffered or occurring during your travel and/or retreat stay.

You agree to a complete an unconditional waiver and release of all liability pursuant to the terms herein, and agreement as to all terms and conditions contained above. You are of lawful age and competent to accept these terms.

I HAVE FULLY INFORMED MYSELF AS TO THE CONTENTS OF THIS RELEASE AND HAVE READ THE SAME PRIOR TO SUBMITTING MY REGISTRATION AND PAYMENT.
